Terms & Conditions and Practical Information
These terms and conditions regulate the contractual relationship between ALIVE A/S and you who purchase a travel package. The agreement is entered into and performed in accordance with the Package Travel Act (Act no. 1666 of 26/12/2017 on package travel and composite travel arrangements).

Important
These general terms and conditions, together with the other information provided on www.alive.dk and in the itinerary, price list, offer, travel plan and other travel documents, form the contractual basis between the customer and ALIVE.
Conditions for the purchase of single services
When you only purchase a single service, such as an airline ticket or hotel accommodation, you are not covered by the Danish Package Travel Act. ALIVE A/S acts solely as an intermediary for the airline(s) or hotel in question and only receives payment for purchased airline tickets/hotel on behalf of the airline/hotel. The airline/hotel is your contracting party and they are responsible for the correct performance of the service.
The airline’s/hotel’s terms and conditions regulate the contractual relationship and for the applicable terms and conditions, please refer to the airline’s/hotel’s website. As ALIVE A/S is solely the intermediary of the service, the agency is not responsible for the bankruptcy of the airline/hotel or for delays, cancellations or other defects in the purchased individual services in connection with the agreement concluded between you and the airline/hotel.
1. Conclusion of the Agreement
1.1 The contract
The agreement is binding when you have accepted in writing the offer of the content and price of the trip and accepted these and/or other stated terms and conditions for the trip. Payment of the deposit or the full price of the trip is also considered acceptance of the offer. It is a prerequisite that the travel services that together constitute a travel package are purchased at the same time.
1.2 Travel Documents
ALIVE A/S will send an order confirmation without undue delay after the conclusion of the agreement.
Order confirmations and other correspondence between you and ALIVE A/S, including – but not limited to – changes to the travel package, will be sent to the postal address or e-mail address that you have used in connection with the conclusion of the agreement.
If you have not received your order confirmation within five days of entering into the agreement, and no later than one week before your departure, you must contact ALIVE immediately. If you have provided an e-mail address, you must check the spam filter beforehand.
You are also obliged to provide the contact information necessary for ALIVE A/S to contact you both before and during the trip. Upon receipt, you are obliged to review the travel documents and any “practical information” (see section 5.3.)
You must immediately respond to ALIVE A/S if the information is not in accordance with what has been agreed.
2. Price and Payment
2.1 Price
The total price of the trip is stated on your invoice, which means, unless otherwise stated, that the invoice includes all mandatory taxes, duties and all additional fees, costs and any supplements related to the services you have purchased from ALIVE A/S. If there are changes in the specific trip or in the conditions for it as a result of your circumstances, the price may change and additional payment may be charged.
At the destinations, local fees, entrance fees and taxes may be charged, which it is not possible to charge at the conclusion of the agreement, as these payments relate directly to local regulations or to the consumption of additional services beyond what is stated in the agreement.
2.2 Payment
If you breach your part of the agreement with regard to payment, ALIVE A/S has the right to cancel the agreement. In such cases, ALIVE A/S is entitled to payment of the amount that you would have lost according to the rules in section 7.2 if you chose to cancel the trip on the day of the non-payment.
2.3 Deposit
In connection with your acceptance of the offer, a deposit of at least 20% of the total price of the trip is payable – unless otherwise stated on the invoice. The deposit includes all non-refundable services.
Some trips may have an increased deposit, which will be stated on your invoice.
If the agreement is made less than 65 days prior to departure, the full price of the trip is payable upon acceptance of the offer. The same terms apply to coach travel. Cancellation insurance must be paid together with the deposit. See also section 7.2 for cancellation terms.
2.4 Final Payment
The balance for the trip must be paid no later than 65 days before the departure date, unless otherwise stated on the invoice.
3. Connecting Trips
ALIVE A/S is only responsible for a connecting trip if it is marketed/purchased together with the main event as part of the package tour. A connecting trip means transportation from/to the place where the package tour begins and ends, respectively.
4. Cancellation and Travel Insurance
ALIVE A/S recommends that you take out cancellation insurance to cover your expenses if you have to cancel the agreement due to acute illness or injury to yourself or a close family member. Cancellation insurance must always be taken out when the agreement is entered into and covers you until the time of departure. If you fail to take out cancellation insurance – or if the trip is canceled for reasons not covered by the insurance, ALIVE A/S’ cancellation terms and conditions apply, cf. section 7.2.
ALIVE A/S will inform you about the possibility or obligation to take out travel insurance. Without travel insurance, you are responsible for costs during the trip in case of accident, illness, hospitalization, repatriation, etc. If you have a chronic or known condition, you should apply for a pre-assessment from the insurance company to be guaranteed coverage during the trip. ALIVE A/S is included in the Danish Financial Supervisory Authority’s public register of companies that meet the
the conditions for registration to practice ancillary insurance mediation. If you wish to complain about ALIVE A/S as an insurance intermediary, your complaint must be directed to the general insurance company that sells the insurance products.
ALIVE A/S is an intermediary of insurance products and receives commission from the insurance company: Gouda Rejseforsikring, A.C. Meyers Vænge 9, 2450 Copenhagen SV. The insurance company is covered by the Guarantee Fund for non-life insurance companies.

5. General Obligations of the Traveler
5.1 PASSPORT, VISA AND HEALTH FORMALITIES (INCLUDING VACCINATIONS)
You must be in possession of and bring with you on the trip a valid passport and the documents necessary for the trip
necessary documents, such as visas and proof of required vaccinations. Even though Denmark is part of the Schengen cooperation, all travelers must always carry a valid passport. For the passport to be valid, all pages must be clear and the passport must have room for new stamps. You must have a passport with a minimum of 6 months validity at the end of your trip.
ALIVE A/S will inform you of the entry requirements necessary for the trip (e.g. passport, visa and vaccination requirements). ALIVE A/S can only provide information about the requirements that apply at the time of the conclusion of the contract. You should be aware that different entry requirements may apply at the time of your departure than what was applicable when you purchased the trip.
For visas, you should also be aware that the processing time for visa applications varies from country to country and you are advised to always apply for a visa well in advance of departure. It is your own responsibility to ensure that your passport complies with applicable regulations.
Please note that the passport must be in good condition before departure. The passport must not be damaged by water, tears, torn surfaces from luggage tags, etc. There must also be no missing pages and no writing or corrections in the passport. In some cases, you may be denied check-in by the airline and entry by the authorities at the destination if they assess that the passport is not in good condition, and the entire trip is basically lost.
ALIVE A/S information about passport and visa requirements is based on the rules for Danish citizens. If you do not have a Danish passport, or if you have dual citizenship, you must make ALIVE A/S aware of this so that you can receive correct advice and guidance, including referral to the relevant authorities. In this context, see www.um.dk and www.ssi.dk.
ALIVE A/S will also inform you of any health formalities such as vaccination requirements or similar, as well as other documents and conditions that are necessary for the completion of the trip. For certain countries, special rules for entry and exit apply. ALIVE A/S cannot be held liable if, after the conclusion of the agreement, special disease-related entry requirements are introduced before or during the trip or restrictions at the destination (e.g. distance requirements, face masks, etc. but not limited to this).
In these cases, you are not entitled to compensation, to cancel the purchase or to cancel free of charge. If you do not wish to complete the trip in such situations, the general cancellation terms, see section 7.2, will apply. You can contact ALIVE A/S for further information about these rules. If you bring medication containing euphoriant substances, you are responsible for being able to document the need for this. Please contact your own doctor for documentation.

If the participants on your trip are minors unaccompanied by their parents/guardian, you must contact the embassy/consulate of the travel country. You should also be aware that special rules apply if your children are traveling with only one of their parents. 5.2 Persons with reduced mobility
ALIVE A/S’s travel services are generally based on the assumption that you are self-reliant or travel with a helper, if this is required. This means that you are able to walk normally, get in and out of transportation, carry your own luggage and manage stairs.
It is therefore important that you provide ALIVE A/S with all necessary and relevant information about your special needs that may affect the suitability of the trip for you prior to booking your trip. For example, this could be medical conditions, pregnancy, impaired vision or if you have walking difficulties, are in a wheelchair or otherwise have reduced mobility.
It is a prerequisite that you inform us of such needs so that the travel consultant can advise you further about your trip and whether all or part of it will be suitable for you, including whether you will get the full benefit of the trip.
The individual trip will state whether or not it is suitable for people with reduced mobility. If you are in doubt about whether the desired trip is suitable for people with reduced mobility, please contact ALIVE A/S who can advise you further.
For group trips/excursions with others, please understand that the rest of the group cannot be delayed, and you must therefore agree to forego certain experiences.
If you bring a walker or wheelchair, this must be agreed in advance when booking the trip so that the travel consultant can write it on the travel voucher for hotel and transportation information.
5.3 Names on Travel Documents
You are responsible for ensuring that the names on your travel documents and bookings are identical to the full name on the passports of the travel participants. There is space for a limited number of characters on an airline ticket, so there will often be no room for middle names, which may be shortened or omitted entirely. If you become aware of any discrepancies between travel documents and passports, you must immediately notify ALIVE A/S, who will attempt to correct the error. If the discrepancy is due to your circumstances, the associated costs will be borne by you. If changes are not possible, you cannot hold ALIVE A/S responsible for this.
5.4 Timely Attendance
In cases where you cannot arrive on time for the travel service ordered, you must contact the supplier in question and inform them of the late arrival. If you do not reach a satisfactory solution with the supplier, you must contact ALIVE A/S. If you fail to contact the supplier and/or ALIVE A/S, the reservation will be canceled by the supplier, and you will not be able to use the reservation or have the payment for it refunded.
If airline tickets are part of the package tour, these must be used in the correct order. If you do not use the flight tickets in the correct order, the airline will cancel the remaining flight legs. Therefore, you cannot only use individual legs of a flight. For example, you cannot only use a return flight.
You must have completed any check-in in accordance with the times and places indicated in the itinerary or by other clear times and places for the last check-in on the outbound and return journeys. You are responsible to the check-in staff for drawing attention to yourself in the check-in queue if you can foresee that you will not be able to complete check-in by the stated times.
You must keep yourself informed of departure times by informing yourself well in advance of your departure whether any changes have been made or announced to the departure time stated in the travel documents. This can be done through ALIVE A/S’s partners at the destination, at ALIVE A/S or on the airlines’ websites.
You must keep yourself updated on departure points and times for the included means of transportation. This can be done, for example, by checking the information screens immediately upon arrival at an airport and contacting airport staff if in doubt about which terminals or gates the flight is departing from. Terminal and gate changes occur frequently and are beyond the control of ALIVE A/S. In such situations, you cannot make a claim against ALIVE A/S.
5.5 Terms and Conditions
You must comply with the rules of conduct that apply to all subcontractors of the package tour, such as hotels, airports, means of transportation, etc.
You must behave in such a way that fellow travelers do not feel inconvenienced. In serious or repeated cases, inappropriate behavior may lead to you being expelled by ALIVE A/S or its representatives from further participation in the trip. In such cases, you are responsible for your own repatriation and expenses resulting from this.
In the event of expulsion, you are not entitled to receive any form of compensation, including a refund of the price of the package tour.
ALIVE A/S is not liable to public authorities, including – but not limited to – police intervention/action against you as a traveler in connection with inappropriate behavior. In such situations, you are responsible for any expenses you may incur, just as you cannot make a claim against ALIVE A/S and will not be entitled to compensation, including a refund of the price of the package tour.
5.6 Non-compliance
If you do not comply with the requirements for passports, visas, other required documents, health formalities, stating the correct name on the travel documents and reviewing them, the rules on punctual attendance and the rules of order, you cannot claim against ALIVE A/S, the intermediary or the subcontractor for the package tour for the consequences, defects, inconvenience or loss that the non-compliance with your general obligations entails.
6. Changes to the agreement entered into
6.1 Transfer to the Package Tour
You can transfer the trip to another person, against a handling fee and any costs ALIVE A/S may be charged by the subcontractors of the package tour as a result of the transfer. Notice of transfer must be given in writing to ALIVE A/S no later than 7 days before the commencement of the trip. Notification after this time will result in you losing the right to transfer the package tour.
Transfer can only take place if the person to whom the package tour is transferred meets the necessary conditions and requirements stated by ALIVE A/S at the conclusion of the agreement for the completion of the trip, including passport, visa and health requirements.
The right to transfer the package tour may be restricted by ALIVE A/S in whole or in part if the transfer is not possible due to the subcontractor’s terms and conditions. Restrictions on transferability will always be clearly stated in your travel documents.
In this connection, your attention is drawn to the fact that the vast majority of airline tickets included in travel packages cannot be changed or refunded once booked (“non-refundable” tickets). If the travel package contains such travel services, the price of the travel services subject to these restrictions will be lost if a trip is changed after booking.
The transferor of the travel package and the person to whom the travel package is transferred are jointly and severally liable for payment of any outstanding amounts and costs resulting from the transfer.
6.2 Price Changes
Price changes
The tour operator may make changes to the agreed price for the package tour after the agreement has been concluded if there are changes in:
– the price of passenger transportation due to the cost of fuel or other energy sources,
– taxes, duties or fees for the package travel services imposed by a third party not directly involved in the provision of the package travel,
– exchange rates that have an impact on the package tour.
The calculation of these changes shall be made according to the calculation examples below:

If part of the package price is paid in a currency other than DKK, this amount or its share of the total price will be stated on the invoice. Foreign currencies used to calculate the price of the package tour will be stated on the invoice, indicating the currency denomination, the exchange rate and the date of the fixed rate.
In the event of changes in the price of the trip, the tour operator will notify the traveler of price increases and price reductions. The notification must be made on a durable medium and no later than 20 days before departure. The price can be increased by a maximum of 8% of the package price. If the increase is more than 8% of the package price, the traveler will be entitled to cancel the contract.
In the event of a price decrease due to changes in the above conditions, the traveler is entitled to a price reduction corresponding to the price decrease caused by the changes. In this connection, the tour operator is entitled to deduct costs associated with the refund to the traveler.
6.3 The Travelers’ changes to the Package Tour
If you wish to make changes to the travel package, you must contact ALIVE A/S as soon as possible. If it is possible for ALIVE A/S to change the travel package, you must pay the extra costs incurred by the changes plus a change fee. It is considered a change if dates/times are changed, if the number of participants is adjusted, if the itinerary is changed, or if changes to the type of accommodation are requested. ALIVE A/S is not obliged to make changes to the package tour.
If you wish to make changes that ALIVE A/S cannot fulfill in the existing agreement, the change will, if you maintain the wish to change the package tour, be considered a cancellation of the purchased package tour, cf. section 7.2, and thus become a new booking.
6.4 ALIVE A/S’s Changes to the Package Tour before the start of the Package Tour
6.4.1 Insignificant changes
ALIVE A/S is entitled, prior to the commencement of the package tour, to make non-material changes to the package tour without your consent. You are obliged to accept such changes if ALIVE A/S clearly and unambiguously informs you of the changes before the commencement of the package tour without undue delay.
6.4.2 Other changes
If ALIVE A/S before the commencement of the package tour either;
– makes significant changes to the package tour
– or cannot provide certain services that you have requested and that ALIVE A/S has agreed to provide,
– or increases the price of the trip by more than 8%.
You have the following rights:
– You may cancel the contract and receive a refund of the amounts paid in relation to the trip,
– or you can participate in a replacement trip, if this is offered by ALIVE A/S.
ALIVE A/S is obliged to contact you without undue delay and inform you of the significant changes, as well as any impact they may have on the price of the package tour.
ALIVE A/S will set a reasonable deadline for you to inform you of your decision, and will also inform you that the consequence of not meeting this deadline means that you are deemed to have accepted changes covered by 6.4.2.
In certain situations, you may be entitled to compensation if you have suffered a financial loss as a result of the above material changes, unless the cause is due to unavoidable and extraordinary circumstances.
7. Termination of the Agreement
7.1 Right of withdrawal
No right of withdrawal applies to the purchase of package tours, cf. section 18(2)(1) and section 7(2)(5) of the Consumer Contracts Act, which excludes passenger transport from the scope of the Consumer Contracts Act.
7.2 Cancellation of the Package Tour
7.2.1 Normal cancellation terms
Unless otherwise stated on your invoice, the following applies:
– If canceled no later than 65 days before the departure date, ALIVE A/S will refund the amount already paid less a fee corresponding to the deposit paid and any cancellation insurance, (annual) travel insurance and other fees.
– If canceled later than 65 days before the departure date, ALIVE A/S has the right to charge the full price of the trip as a cancellation fee.
If the entire package tour or parts of its travel services are subject to stricter cancellation conditions than the above, these will apply and will be stated on the invoice.
7.2.2 Cancellation in the event of acts of war etc.
You may cancel a package tour without paying a fee immediately before the start of the package tour if unavoidable and extraordinary circumstances occur at the travel destination or in its immediate vicinity circumstances that significantly affect the provision of the package tour or the transportation of passengers to the destination.
In order for you to cancel without paying a fee, the unavoidable and extraordinary circumstances in question must make it impossible to travel safely to the destination based on an objective assessment; e.g. based on guidance or statements from the Ministry of Foreign Affairs, health authorities etc. See www.um.dk and www.ssi.dk.
In the event of a fee-free cancellation, you are entitled to a full refund of the price of the trip, but are not entitled to further compensation from ALIVE A/S.
The right to cancel free of charge does not apply if you knew or should have known about the event in question when the agreement was entered into, or if the event was otherwise generally known.
If you cannot cancel free of charge in accordance with the above, the general cancellation terms apply, see section 7.2.1.
For round trips, you only have the right to cancel the part of the package that takes place in the non-advised area. Only if this part constitutes a significant part of the total package, you have the right to cancel the entire trip.
7.2.3 Time of refund and calculation of cancellation fee
Repayment of amounts according to sections 7.2.1 and 7.2.2 must be made within 14 days of your cancellation of the package tour. If you have paid by credit card, the amount will generally be refunded to the same payment card.
7.3 Termination from ALIVE A/S
7.3.1 Termination due to unavoidable and extraordinary circumstances
ALIVE A/S may terminate the travel package agreement without liability if ALIVE A/S is prevented from fulfilling the agreement due to unavoidable and extraordinary circumstances. In this case, ALIVE A/S must notify you of the termination of the agreement without undue delay and before the start of the package tour.
In the above termination situations, you will be refunded the amounts paid for the trip no later than 14 days after notice of termination. You will not be entitled to further compensation.
8. Defects and Complaints
If you experience any deficiencies on your trip, you must complain to ALIVE A/S, its representative at the destination or the subcontractor providing the travel services in question immediately after the deficiencies have been discovered. If our representative or subcontractor cannot remedy the defects satisfactorily, you must contact us immediately by [phone, email, app, etc.] Failure to comply with the obligation to complain may have consequences for your right to compensation. You must therefore ensure that you have documentation for your complaint in the form of a receipt or similar.
If you experience any deficiencies on your trip, you must complain to our guides at the destination or the subcontractor providing the travel services in question immediately after the deficiencies have been discovered.
If the complaint is directed to the subcontractor and the subcontractor is unable to remedy the deficiencies satisfactorily, you must contact our guides immediately. Contact information for the guides:
If you do not comply with the duty to complain, this will have consequences for your right to compensation. You must therefore ensure that you have documentation for your complaint in the form of a receipt or similar.

9. Limitations on ALIVE A/S’s liability for damages
The airlines are directly responsible for the proper performance of the transportation under the Warsaw and
Montreal Conventions, EU Regulation 889/2002 and 261/2004 and the Danish Aviation Act.
ALIVE A/S limits its liability to the limits applicable at any given time under the Warsaw and Montreal Conventions (air transportation), the Athens Convention, EU Regulation 392/2009 (maritime transportation), the COTIF Convention and EU Regulation 1371/2007 (rail transportation). ALIVE A/S’s liability cannot therefore exceed the amount that applies to the carriers who are directly responsible for the carriage.
Any compensation is calculated in SDR (Special Drawing Rights). The current SDR rate (XDR) can be found at www.nationalbanken.dk
Under the Warsaw and Montreal Conventions, the limits on the maximum compensation are set at:
– For death or injury of passengers: 151,880 SDRs – if the air carrier can prove that it has not acted negligently or improperly, or if the incident was caused by the negligent or improper conduct of a third party
– For damage caused by delay of passenger transportation: 6.303SDR
– For destruction, loss, damage or delay of baggage: 1,519 SDR
The limits of the maximum compensation under the Athens Convention and EU Regulation 392/2009 are set at:
– In case of death or injury of passengers: From 250,000 SDRs to 400,000 SDRs – depending on the cause of the injury and the fault of the carrier
– In case of destruction, loss or damage to hand baggage: 2,250 SDRs
– Destruction, loss of or damage to vehicles, including luggage in or on the vehicle: 12,700 SDRs – the Carrier is only liable for damage caused by fault on its part
– Destruction, loss or damage to baggage other than hand baggage and vehicles: 3,375 SDRs
So-called “valuables” are not compensated under the rules.
The limits on the maximum compensation under the COTIF Convention and EU Regulation 1371/2007 are set at:
– For death and injury of passengers: 175,000 SDRs
– Loss of or damage to property: 1,400 SDR
– In case of total or partial loss of a vehicle: 8,000 SDR
– Damage to objects left in the vehicle: 1,400 SDR – the carrier is only liable for damage caused due to its fault
For bus transportation, the limitations for death or injury and loss of or damage to luggage are damage to luggage follow from Regulation 181/2011 of February 16, 2011 on the rights of bus and coach passengers.
If the liability of the carrier is not limited in other EU legislation or in other international conventions, ALIVE A/S limits its liability to three times the total price of the package.
10. Submission of Claims after the end of the Trip
Claims for compensation and/or a proportionate reduction in the price of the trip – as a result of defects that have been correctly reported and not remedied by ALIVE A/S – must be made to ALIVE A/S within a reasonable time after the end of the trip. Otherwise, you lose the right to make a claim against ALIVE A/S.

11. Access to set-off in the Payment of Damages and/or Compensation
When submitting your claim to ALIVE A/S, you must state whether you have also applied for
damages or compensation from the carrier on the basis of EU regulations on passenger rights and liability in passenger transport and according to the international conventions that also regulate this matter.
If you have received compensation and/or damages from the carrier, ALIVE A/S is entitled to set off compensation and/or damages under the Act on Package Travel and Composite Travel Arrangements against the compensation and/or damages you have received from the carrier.
12. Juristiction and Choice of Law
If agreement on a claim for damages and/or amount etc. cannot be reached by complaining to ALIVE A/S or the intermediary, you can bring a complaint to the Pakkerejse-Ankenævnet, Haldor Topsøes Allé 1, st. building 91. 2800, Kgs. ALIVE A/S is – as a result of its membership of the Danish Travel Agents Association – obliged to comply with orders from the Package Travel Complaints Board, unless the board of the association grants an exemption from this requirement because the order is to be brought before a Danish court, cf. the association’s statutes.
All disputes and disagreements that may arise or arise from the creation and/or performance of a given agreement and which cannot be resolved between the parties alone or by the Package Travel Complaints Board, shall, if the
parties wish to bring the matter before the Danish national courts for final decision, and will be governed by Danish law, unless otherwise provided by Rfor. 1215/2012 and the Rome Convention of 1980.
13. Guarantee in the Travel Guarantee Fund
In the event of bankruptcy, ALIVE A/S has guaranteed reimbursement of the traveler’s payments with
Rejsegarantifonden, Haldor Topsøes Allé 1, st. building 91. 2800, Kgs. Lyngby. Registration number [2655].
